It appears some users are having wifi issues. Try a "Reset Network Settings" Also, this just enables custom MobileConfig files. To fully enable tethering, go here on your iPhone and download a MobileConfig file for your carrier. Watch out for carrier fees for tethering.
NOTE: Blackra1n RC3 is still a tethered jailbreak for 3GS units released after week41 and the new ipod touch 3rd gen. Bigboss' comment about it from

For iphone 3GS fw3.1 OTB and ipod touch 8gb units, "
Tethered Jailbreak" means that your device must be connected to a computer in order to be turned-on in order retain all the components/applications of Jailbreak.
Rebooting the unit untethered will cause you to lose your jailbreak.

So, what is blackra1n? blackra1n is a 30 second ALL device 3.1.2 jailbreak. Even the ipt3, but the ipt3 is tethered. In order to boot it, just rerun blackra1n. As far as donations go, they are much appreciated, but not until after blackra1n works for you. I never ask for donations before the tool is released.
Warning 3g and 3gs unlockers, do not upgrade to 3.1.2 using iTunes if you want to keep your unlock. Baseband cannot be downgraded. Check out the dev team's offerings. Also blackra1n doesn't hacktivate.
iClarified tutorial warning:
WARNING: Even though the GeoHot jailbreak supports 3.1.2 do not update if you are on iPhone OS 3.0.1 or 3.0. You will lose your unlock. Use PwnageTool to safely update to 3.1 without performing a baseband update. If you really must have 3.1.2 then wait for the next version of PwnageTool. If you have already updated to 3.1 or 3.1.2 without using PwnageTool then you've lost the ability to unlock for the time being. You can now use BlackRa1n to at least regain your jailbreak

Geohot has released blackra1n. This is a 3.1.2 jailbreak for all devices: iphone 2g, iphone 3g, iphone 3gs, ipodtouch 1, 2, 3. It’s pretty easy. You just load the app and click the “make it ra1n” button and follow the prompts. Unfortunately, the ipod 3 is tethered which means if you reboot you have to run blackra1n again.
This is also a jailbreak only. There is no hacktivation or unlock. If you have updated in itunes to 3.1.2 or have an out of box 3.1 iPhone 3g / 3gs, you cannot unlock due to the new baseband, you can only jailbreak. If you have a 3g / 3gs running an older iPhone software and want to update and unlock, wait for pwnage type exploit that lets you update without updating the baseband.

btw #blackra1n works on the ipt3, you just need to run it everytime to reboot the device
This being the case, 3rd Gen iPod Touch users, it's wise to hold-off and wait for a more stable and practical version. GHotz has been known to rush things for releases.

Note for the old Blackra1n RC1:
The RC1 release neglected to include the afc2 service which renders iphonebrowser/ifunbox/iphone explorer unusable. Manual fix via plist editing can be found
here.
An automated method has been released by Netmage (developer of iphonebrowser) called "afc2add". Simply install Afc2add from cydia (modmyi repo) and you'll be all set.
