First off: What state is your phone in right now? Are you able to use it as an iPod touch?
If not, do you have the AT&T SIM card with you?
Reason I ask you those is that if you are able to use it as an iPod touch, there is a possiblity that you can jailbreak it using a couple of the tools available (blackra1n if on 3.1.2, spirit if on 3.1.3) with some provisos, then use ultrasn0w to unlock..
If you are not able to use it as an iPod and it's only option is to make emergency calls only, you will need to activate it first before you can use any of the above jailbreaking tools. If you have a valid AT&T SIM card, just insert it into the phone, connect your phone to iTunes and it will activate your phone making it usable. If you get a notification that there is a software update, please cancel it for the meantime, as what justinred suggests.
